This website is operated by FansDrop (“FansDrop,” “we,” “us,” or “our”).
By accessing or using this website, participating in a Campaign, or purchasing products through FansDrop, you agree to these Terms of Service and any applicable Privacy Policy, Refund Policy, and Shipping Policy.
1. Our Services
FansDrop works with creators, artists, and intellectual property owners to develop original characters, artwork, and designs into plush toys, figures, plush keychains, collectibles, and other merchandise.
Certain FansDrop products are offered through limited-time crowdfunding Campaigns.
The product price, Campaign period, minimum order goal, and other applicable details for each Campaign will be displayed on the relevant Campaign page.
2. Campaigns & Orders
Products offered through a Campaign are crowdfunding pre-order products and are not in-stock items.
An order is considered placed once the customer successfully completes Checkout and payment.
If a Campaign reaches the Minimum Order Goal stated on the Campaign page within the applicable Campaign period, the product will proceed to production.
If the Campaign does not reach the Minimum Order Goal by the end of the Campaign period, the Campaign will be considered unsuccessful. All related orders will be cancelled and all amounts paid will be fully refunded to the original payment method.
Participating in a Campaign constitutes a purchase of merchandise only. It does not constitute an investment in FansDrop, the relevant creator, or any project, and does not provide the customer with any shares, profit participation, ownership interest, or similar rights.
3. Production
Once a Campaign is successful, FansDrop will arrange for the product to enter production.
Production will be completed within a maximum of 90 days from the date the product officially enters production.
The 90-day period applies only to production and does not include international transportation, customs clearance, or final delivery to the customer.
4. Shipping & Tracking
Once production is completed, FansDrop will arrange shipment of the orders.
After an order has been shipped, the customer will receive a Shipping Confirmation Email containing:

The Order Number; and
-
The Tracking Number.
Customers may use the Tracking Number to monitor the shipment status of their order.
Customers are responsible for providing complete, accurate, and valid shipping information when placing an order.
FansDrop is not responsible for delays, failed delivery, or returned packages resulting from an incorrect, incomplete, or undeliverable shipping address provided by the customer.
Any additional costs resulting from such issues, including the cost of reshipping the order, must be paid by the customer.
5. Returns, Refunds & Claims
Except where a Campaign fails to reach its Minimum Order Goal, where otherwise expressly provided in these Terms, or where required by applicable law, all sales are final and non-refundable.
If you receive:

A damaged item;

A defective item; or

An incorrect item,
please inspect your order promptly upon delivery and contact us at info@fansdrop.cc within 7 days of receiving your order.
When submitting a claim, please provide:

Your Order Number;
-
A clear description of the issue; and
-
Photographs clearly showing the issue.
FansDrop will review the claim based on the order information, product condition, and supporting materials provided by the customer.
If the claim is approved, FansDrop may provide a Replacement or Store Credit.
Submitting a claim does not automatically mean that the claim has been approved.
The 7-day claim period does not limit any statutory consumer rights that cannot lawfully be excluded under applicable law.
6. European Union Customers
For customers located in the European Union, FansDrop complies with applicable EU consumer protection laws, including the statutory guarantee of conformity provided under Directive (EU) 2019/771.
Consumers are entitled to a minimum two-year statutory guarantee of conformity for products that are defective or do not conform to the sales contract.
This statutory guarantee applies independently of, and in addition to, any voluntary commercial or manufacturer warranty that may be provided by FansDrop, the manufacturer, or another third party.
Any other mandatory consumer rights available to EU customers under applicable law remain unaffected by these Terms.
7. Product Variations
Certain FansDrop products may involve sewing, embroidery, dyeing, printing, molding, hand assembly, or other manufacturing processes.
As a result, the final product may have minor variations from the product images, renderings, or samples shown on the website, including minor differences in color, dimensions, positioning, or workmanship.
Reasonable manufacturing variations of this nature are not considered product defects.
8. Intellectual Property
The FansDrop platform design, website layout, FansDrop brand name, trademarks, logos, visual elements, and content independently created by FansDrop are owned by FansDrop Limited or lawfully licensed to FansDrop.
Creators working with FansDrop retain ownership of their original characters, illustrations, artwork, designs, and other original intellectual property.
Unless otherwise agreed in writing, working with FansDrop does not transfer ownership of a creator's pre-existing intellectual property to FansDrop.
FansDrop uses creator intellectual property only within the scope of the applicable collaboration and authorization, including where necessary for product development, manufacturing, sales, marketing, and Campaign operation.
Purchasing a FansDrop product gives the customer ownership of the physical product only. It does not transfer ownership of, or grant commercial rights to, any FansDrop trademark, creator character, artwork, design, or other intellectual property.
No person may copy, modify, manufacture, sell, commercially exploit, or otherwise use protected intellectual property without authorization from the relevant rights holder.
9. Shopify Hosting & Third-Party Services
The FansDrop online store is hosted and operated using the Shopify e-commerce platform and related infrastructure.
Shopify provides FansDrop with technical infrastructure for website hosting, product display, order management, and online transactions.
The sale of products through FansDrop is a transaction between the customer and FansDrop Limited.
Shopify is not the seller of FansDrop products and is not responsible for FansDrop Campaigns, product manufacturing, order fulfillment, shipping, or customer service.
Payments may be processed through Shopify and supported third-party payment providers.
FansDrop may also use third-party logistics, payment, analytics, email, customer service, and other service providers to assist with website operations and order fulfillment.
The final product price, shipping fees, taxes, and other applicable charges will be displayed at Checkout.
10. Prohibited Uses
In addition to any other prohibitions set out in these Terms, you may not use this website, the Services, or any content:
(a) for any unlawful purpose;
(b) to solicit, assist, or encourage others to perform or participate in unlawful acts;
(c) to violate any applicable international, national, federal, state, provincial, regional, or local laws, regulations, rules, or ordinances;
(d) to infringe or violate the intellectual property rights of FansDrop or any third party;
(e) to harass, abuse, insult, harm, defame, disparage, intimidate, or discriminate against any person based on gender, sexual orientation, religion, race, color, age, nationality, disability, or any other legally protected characteristic;
(f) to submit false, fraudulent, or misleading information;
(g) to upload, transmit, or distribute viruses, malware, or any other malicious code that may affect the operation or security of this website, the Services, another website, or the internet;
(h) to collect, track, store, or use another person's personal information without authorization;
(i) to send spam, engage in phishing, fraud, impersonation, scraping, crawling, or unauthorized collection of website content or data;
(j) for any obscene, fraudulent, unethical, or unlawful purpose; or
(k) to interfere with, disable, circumvent, or attempt to circumvent the security features of this website, the Services, or any related system.
FansDrop reserves the right to restrict, suspend, or terminate access to the Services for violations of these prohibited uses.
11. Indemnification
To the extent permitted by applicable law, if your violation of these Terms, violation of applicable law, infringement of third-party rights, or fraudulent, unlawful, or unauthorized use of FansDrop causes FansDrop, its creators, affiliates, or service providers to incur third-party claims, losses, liabilities, or reasonable expenses, you will be responsible for losses resulting from your own conduct.
Nothing in this section requires a customer to indemnify FansDrop for liability that must legally remain the responsibility of FansDrop and cannot lawfully be transferred or excluded.
12. Disclaimer & Limitation of Liability
FansDrop does not guarantee that the website or related Services will always be uninterrupted, completely secure, or free from technical errors.
Until a Campaign reaches its Minimum Order Goal, FansDrop does not guarantee that the Campaign will proceed to production.
To the extent permitted by applicable law, FansDrop will not be liable for indirect, incidental, special, or consequential losses resulting from force majeure events, customs delays, major supply-chain disruptions, third-party logistics providers, government actions, natural disasters, or other circumstances beyond FansDrop's reasonable control.
Where a system failure or interruption is caused entirely by Shopify, a payment provider, logistics provider, or another third-party service outside FansDrop's reasonable control, FansDrop's liability will be limited to the extent permitted by applicable law.
Nothing in this section excludes or limits any liability or statutory consumer right that cannot lawfully be excluded or limited.
13. Changes to These Terms
FansDrop may update these Terms of Service from time to time due to changes in our business operations, website functionality, or applicable legal requirements.
The latest version will be published on the FansDrop website together with the date of the most recent update.
